The Terms and Conditions below apply to the use of the KissShoe.co.uk website, and by placing an order with us you are agreeing to accept them. They also comply with UK legislation, including the Distance Selling Regulations/Consumer Contracts Regulations.
Orders may be placed using the KissShoe.co.uk website. We are unable to take orders over the phone or via email requests. We reserve the right to cancel or refuse any orders from a customer with whom there is a dispute relating to the payment of a previous order or who appears to present some form of risk.
All orders imply acceptance of the prices and product descriptions available at the time of sale. KissShoe.co.uk undertakes to honour the orders received on the website subject to product availability. If one or more products ordered are not available, we will inform the customer as soon as possible. The customer's order will therefore be cancelled and the corresponding amount refunded.
We accept all major credit cards and debit cards via our online payment gateway. Payments will be encrypted to ensure secure electronic transmission of data. Payment can also be made using PayPal.
Payment must be made in full in one instalment.
KissShoe.co.uk reserves the right to check the personal information given by the customer and to adopt any measures deemed necessary to check that the person whose bank account is being debited is the person who placed the order. This is to prevent any fraudulent payments. This check may take the form of a request for proof of identity and/or address and/or bank documents. If the customer fails to respond to such a request within seven working days, the order in question will be automatically cancelled, with no option to make a subsequent complaint. KissShoe.co.uk is entitled to directly cancel an order that presents one or more risk factors of fraudulent bank card use.
We may terminate the contract at any time and/or claim damages for breach of contract if we suspect that you have made a fraudulent misstatement to us, whether orally or in writing, prior to or after entering into the contract.
Ownership of the goods shall not pass to you until we have received in full all monies owed by you to us under this contract and any other contract with us.
All prices listed on KissShoe.co.uk are correct at the time the information is placed and all prices include VAT at the current UK rate. We reserve the right to modify our prices at any time without prior notice. The products will be invoiced according to the prices in effect at the time the order is completed.
We try to be very competitive with our prices, but should a product be listed at an incorrect price due to typographical error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed.
We value your privacy and the information set out below explains what data we collect, why we collect it and how we use your details. Please remember that you can access and browse our site without disclosing any personal data. When you place your order on our website we will ask you to register by providing your name and full address details (and delivery address if different to your billing address), contact telephone number and e-mail address. This information will be securely stored - it is only accessible to you via your username and password. You should keep your username and password secure at all times as they will help you retrieve your details and make ordering quick and easy.
We use the information you provide us:
• To administer your account and we may disclose your details to our third party service providers for the purposes of processing your order only. We will not pass your details on for third party marketing or promotional activities.
• To let you know via email, post or phone about new KissShoe.co.uk products or services that may be of interest to you.
We may pass on non-personal aggregated information about sales and website usage to reputable organisations for research or analysis purposes.
We will never share any personal information that you give us with a third party except to enable us to process your order or where we are required to do so by law.
In common with other websites we use ‘cookies’. These are small files that our website puts on your hard drive so that it can remember information about you at a later date. Our online ordering system uses a cookie to record a unique reference on your computer so that we can keep track of your order and retain the contents in your shopping basket.

We take your online security seriously and protect the information you provide us by:
• Placing your order through an advanced secure server which encrypts all the information you input before it is sent to us.
• Encrypting credit card numbers both before an order is processed and when stored on the database.
• Complying with the standards, procedures and requirements laid down by the UK Data Protection Acts 1984 and 1998 to ensure that your personal information is kept secure and processed fairly and lawfully.
To check the security of our website, simply look in the lower bar of your browser when you fill in your payments details. You will see an unbroken key or closed lock, showing that the encryption is active and your information is secure. For security reasons, we recommend that you do not send credit card numbers by standard email, but use the secure payment facility which we provide.
Orders placed on the KissShoe.co.uk website before 12pm Monday to Friday (except national holidays) will be processed and dispatched the same day or the next working day, subject to receiving cleared payment.
We endeavour to deliver all items within the time scales given on our Delivery page relative to the chosen delivery method; however, we are reliant on third party carriers and cannot be held liable for any delays and/or loss caused by a delay.
The maximum timeframe we would allow for delivery of goods is 30 days from the day after an order was placed (excluding non-working days Saturdays, Sundays and Bank Holidays). If an order is delayed we will open an investigation with the courier used and keep the customer updated on the situation where possible.
If you miss the delivery of your order you will be able to arrange a re-delivery or collection of the goods directly with the carrier.
All risk of loss of or damage to the goods shall pass to the customer upon delivery.
If you order goods from our website for delivery outside the UK, they may be subject to import duties and taxes, which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the goods are destined. We will not be liable for any breach by you of any such laws.
In the unlikely event that you are not completely satisfied with your purchase you are entitled to an exchange or refund within 30 days from the date of delivery. Please see the Returns Procedure if you wish to return any items.
We will only grant an exchange or refund if footwear is returned in its original condition. In order to ensure this is the case, we recommend that footwear should be worn on a carpeted surface when being tried on. Should the footwear appear scratched, marked, soiled, worn or damaged, we will not grant the exchange or refund request. The item(s) returned must include all packaging including any tissue paper, tags and the intact original box which must not have any sticky tape or glue attached to it. You have a legal obligation to take reasonable care of the goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
On receipt of the package, KissShoe.co.uk will judge whether the goods are in perfect condition. No returns will be accepted if the goods have been visibly used or damaged and if this use or damage has rendered the products unsuitable for sale. If the return is refused by KissShoe.co.uk, the goods will then be returned to the customer at our expense. If the damage is limited then KissShoe.co.uk reserve the right to offer a refund of a lower amount than the purchased price, relative to the level of damage.
We recommend that you use Royal Mail Special Delivery or Royal Mail Signed For and obtain a proof of postage so that the items are insured and traceable for your own peace of mind. We cannot accept responsibility for any delays or losses in transit for returned items, we can only refund items we have received back in the condition stated above.
When exchanging goods, the exchange order will be dispatched within 2 working days of the returned items being received. If the amount of the customer's exchange order is more than the initial order, the difference may be paid online by debit/credit card or via PayPal. The dispatch of the customer's exchange order is conditional upon confirmation of this payment. If the amount of the customer's exchange order is lower than the initial order, KissShoe.co.uk will refund the difference within 7 working days of receipt of the returned item.
We will refund returned goods within 2 days from the date of receipt. We will usually refund any money using the same method originally used by you to pay for your purchase. Should this not be the case we will contact you promptly to inform you of the refund method.
Your statutory rights are not affected when returning purchased goods.
Cancelling your order
Customers have the right to cancel any order placed on our website without needing to provide a reason. Customers can do this by e-mailing us at [email protected] and quoting your order number with a clear request to cancel the order. Customers have the right to cancel an order within 14 days from the date of delivery and the goods can be returned for a refund if the cancellation request is received subsequent to the dispatch of the goods ordered. The customer then has a further 14 days from the date of the cancellation request to return the goods back for a refund. The cost of returning the good will be the responsibility of the customer. Please ensure you provide us with your name, address, the product(s) ordered including the size and your order number. If a customer cancels the contract, all payments received from the customer will be refunded to the original payment method used. This includes the delivery charge if applicable for our lowest cost standard delivery option only. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is a result of unnecessary handling by the customer.

Our goods are checked for quality before they are dispatched and customers will not be liable for basic defects arising in workmanship and/or failure in use. Customers are required to fully inspect goods before wear and should any faults be present the customer should notify the company promptly and arrange a return and refund in line with the Return Policy before wearing/using the item. We do not offer any guarantees against standard wear and where this is the case no refund or exchange will be offered outside of the timescales indicated in our Returns Policy.
We suggest that you take good care of your footwear by replacing the heels/soles when they show signs of wear. Certain styles of footwear should not be worn in unfavourable weather conditions. Taking adequate care when putting on or taking off footwear can also help to prolong their length of use.
Defective goods, which have been returned by you, will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.
We warrant to you that any goods purchased from KissShoe.co.uk are of satisfactory quality and reasonably fit for all the purposes for which goods of such kind are commonly supplied.
KissShoe.co.uk has an obligation only to use its best endeavours throughout all the stages regarding accessing the site, the ordering process, delivery, customer service and after-sales. We cannot be held liable for any damages or inconveniences inherent to using the internet network, specifically a disruption of services, an external intrusion or computer viruses. We will not be responsible for any losses resulting from your usage or inability to use this website, nor will we be responsible for any loss of profits, costs incurred or any other losses which have not been caused directly by us.
Customer complaints will be handled promptly and fairly. Should a customer wish to raise a complaint that relates to an order placed on the KissShoe.co.uk website the details of the issue should be sent to [email protected] and the internal resolution process will commence. The customer can file a complaint via the European Online Dispute Resolution platform should they feel their complaint has not been satisfactorily resolved. KissShoe.co.uk may contain links to third party websites or services which are not operated by us. In these instances KissShoe.co.uk is not responsible for the content as it is not controlled by us. You must refer to the destination terms and conditions to ascertain you rights.
We make every effort to reproduce colours on KissShoe.co.uk as accurately as possible, however, colour displays can be different depending on your computer settings, so exact colour matches are not possible. This means that colours of the products you order may differ from what you see on screen. If you are not satisfied with the colour of the goods you have ordered then you are welcome to return them.
Voucher Codes/Free Gifts/Promotional Offers
Voucher codes are the discount codes we offer to particular groups of customers. The percentage discount varies depending on the individual promotion. Any expiry dates shown will be enforced and the voucher will not be valid on KissShoe.co.uk after this date. Please note that a voucher discount code can not be used on any goods which have already been discounted. For vouchers which display a monetary value, this is only redeemable as per the terms and conditions detailed as part of the specific promotion and only valid to be used at KissShoe.co.uk. Vouchers can not be exchanged for any other offers and no change can be given when using a voucher as payment.
KissShoe.co.uk may offer free gift promotions on occasions. Under the terms of the Sale and Supply of Goods to Consumers Regulations 2002 free gifts linked to the purchase of a particular product or a specified value form part of that purchase contract. In the event that you wish to return that purchase, then the free gift must be returned to us at the same time.
Promotional offers may be withdrawn at any time.
KissShoe.co.uk owns all rights to the design of the images, text and all of the information provided on our website, copyright and other intellectual property rights protect them. You must not copy or use any of the information provided by our website for any other purpose than for the purchase of footwear from us. Any copying, downloading or other unauthorised use of any of the material on the website is strictly forbidden
Right to Vary Conditions
We have the right to revise and amend the Terms and Conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
You will be subject to the policies and Terms and Conditions in force at the time that you order goods from us, unless any change to those policies or the Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you) or if we notify you of the change to those policies or the Terms and Conditions before we send you the confirmation of dispatch email (in which case we have the right to assume that you have accepted the change to the Terms and Conditions, unless you notify us to the contrary within seven working days of the goods being received by you).
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (‘Force Majeure Event’).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; and the acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
